Welcome to NexxtLevel Careers (“Company,” “we,” “our,” or “us”). By accessing our website, purchasing our programs, or participating in coaching services, you agree to the following Terms and Conditions. Please read carefully, as they form a binding agreement between you (“Client,” “you,” or “your”) and NexxtLevel Careers.

1. Services Provided

NexxtLevel Careers offers career and interview coaching services, including:
- The Your Job Search Playbook (YJSP) program
- One-on-one coaching sessions
- Interview coaching and practice sessions
- Resume, LinkedIn, and branding consultations
- Group coaching and workshops
- Other services as outlined on our website or in separate agreements

All services are designed to provide support, guidance, and tools to assist in career development. We do not guarantee specific employment outcomes.

2. Payment & Fees

- Payment for services must be made in full or according to the payment plan agreed upon at the time of purchase.
- Payment plans, if offered, must be completed in full regardless of whether you complete or attend all sessions.
- Refunds may be offered in certain circumstances and are determined based on the specific program purchased. Details regarding eligibility and process will be outlined at the time of enrollment.
- Refund policies may differ for group programs, one-on-one coaching, or digital products, and will be clearly communicated at the time of purchase.

3. Scheduling & Cancellations

- Coaching sessions are scheduled by mutual agreement, typically via Zoom or another virtual platform.
- We kindly request 24 hours’ notice for cancellations or rescheduling. Missed sessions without notice may be forfeited.
- Emergencies will be handled with understanding on both sides.

4. Client Responsibilities

By engaging our services, you agree to:
- Participate actively and honestly in the coaching process.
- Complete exercises, assignments, or practice sessions as recommended.
- Communicate promptly regarding scheduling or payment matters.

You understand that results depend on your own effort, actions, and follow-through.

5. Confidentiality

We respect your privacy and the information you share during coaching sessions. All personal information will be kept confidential, with the following exceptions:
- As required by law, or
- If there is a risk of harm to yourself or others, or
- We may use anonymized examples drawn from coaching sessions for training, educational, or illustrative purposes, provided that no personally identifiable information (such as your name, employer, or specific circumstances) is disclosed.
- With your explicit permission, we may share identifiable success stories or testimonials for marketing or promotional purposes.

6. Consent to Recording

Some coaching sessions, practice interviews, or group workshops may be recorded for educational and training purposes. By participating, you acknowledge and agree to the following:
- Individual Sessions: Recordings may be provided to you for your personal review and learning. These will not be shared publicly without your consent.
- Group Sessions: Recordings may be made available to other participants in the same group for shared learning.
- Privacy Options: You may choose to leave your camera off and/or use only a first name (or a pseudonym) if you prefer not to be visually or personally identifiable in group recordings.
- Recordings are the property of NexxtLevel Careers and may not be distributed, copied, or shared without permission.

7. Technology & Access

You are responsible for having the necessary technology (internet connection, Zoom, etc.) to participate in coaching. NexxtLevel Careers is not liable for missed sessions or interruptions due to technical issues outside our control.

8. Health, Wellbeing & Financial Disclaimer

Coaching may involve discussions around stress, career transitions, or life circumstances, but it is not a substitute for therapy, counseling, or medical treatment. You agree to seek professional help if needed.

Coaching often includes conversations about job offers, salary, benefits, or other financial considerations related to career decisions. NexxtLevel Careers provides guidance and strategies to support your decision-making, but does not provide financial, tax, legal, or investment advice. All final decisions regarding accepting or declining offers, negotiating compensation, or making financial choices are your responsibility, and we encourage you to consult with a qualified professional where appropriate.

9. Group Coaching Code of Conduct

We aim to foster a supportive and respectful learning environment. By participating in group sessions, you agree to:
- Maintain confidentiality of group discussions.
- Treat other participants respectfully.
- Refrain from disruptive, disrespectful, or offensive conduct.

NexxtLevel Careers reserves the right to remove participants who violate these guidelines, without refund.

10. Intellectual Property

All materials provided, including but not limited to worksheets, toolkits, and training resources, are the intellectual property of NexxtLevel Careers. They may not be copied, distributed, or shared without written permission.

11. Access to Materials

Access to programs, recordings, and digital resources is for your personal use only. They may not be shared, distributed, or resold.

12. Limitation of Liability

To the maximum extent permitted by law, NexxtLevel Careers is not liable for any indirect, incidental, or consequential damages arising from the use of our services or website.

13. Termination

Either party may terminate the coaching relationship at any time. If NexxtLevel Careers ends the relationship, we will refund any unused prepaid sessions on a pro-rated basis, unless termination is due to misconduct or violation of these Terms.

14. Communication

Coaching includes scheduled sessions and reasonable email communication between sessions. We will do our best to respond promptly, typically within 2 business days, unless otherwise noted.

15. Force Majeure

NexxtLevel Careers shall not be liable or responsible for any delay or failure in performance caused by events beyond our reasonable control, including but not limited to illness, natural disasters, internet outages, or government restrictions.

16. Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of Idaho.
- Any disputes will first be resolved in good faith through informal discussions.
- If unresolved, disputes shall be submitted to binding arbitration in Ada County or Canyon County, Idaho, at the Company’s discretion.
- By agreeing to these Terms, you waive the right to bring claims in court (except as required by law).

17. Website Use

By accessing our website, you agree to use it only for lawful purposes and in a manner that does not infringe on the rights of, or restrict or inhibit the use and enjoyment of, others. Specifically:
- You may not use this site to transmit harmful or malicious code, spam, or engage in fraudulent activity.
- All website content, including text, graphics, and branding, is owned by NexxtLevel Careers and may not be used without permission.
- We may use cookies or similar technologies to improve user experience. By using the site, you consent to this practice.

19. Expectations

Our role is to support, encourage, and equip you with proven strategies and tools. Your results will depend on your own effort, the actions you take, your follow-through, and factors outside of either of our control such as the job market, location, or individual circumstances. We are partners in the process, but the responsibility for making and carrying out career decisions remains with you.

20. Testimonials & Publicity

With your permission, we may feature your feedback, testimonial, or success story in our marketing materials. Otherwise, any examples we use will be anonymized.

21. Updates to Terms

We may update these Terms from time to time. Continued use of our services or website constitutes acceptance of the revised Terms.

22. Entire Agreement

These Terms & Conditions represent the entire agreement between you and NexxtLevel Careers regarding the services described and supersede any prior discussions or agreements.
